Commercial adviser, business partner, legal expert, negotiator, problem solver, trainer, risk manager, project manager, enforcer, fortune teller, therapist ... the in-house lawyer is all of these and more – and operating on an ever-decreasing budget, with limited resources and an inbox fit to burst.  In-house counsel in the construction industry, with its complex projects, challenges around payment, sustainability, technology and new methods of construction, faces this situation daily.

Many of us at Fenwick Elliott have worked in-house and thrived on the proximity to the business, the opportunity to make a difference daily and the interaction with various stakeholders.  We’ve also experienced the pressures.  Now, from the private practice side of the legal and construction world, we’re keen to do what we can to make life easier for construction “in-housers” – or Insiders as we like to call them (beyond any assistance we are giving on particular cases or matters).

So, we have created Insiders, our forum dedicated to in-house counsel within the construction industry, bringing them together for:

1. A quick-fire update on relevant recent cases;
2. A more detailed focus on a hot topic within construction law;
3. Training on general counsel skills; 
4. Insight into the commercial and operational sides of the industry; and
5. Some networking with others involved in in-house counsel.

The inaugural session saw:

1. Fiona Sinclair QC discuss the legal issues that insolvency within the supply chain can cause and the practical implications; 
2. The Fenwick Elliott team offer some practical drafting tips following recent cases concerning liquidated damages, completion, defects, force majeure and good faith; 
3. Keith Waller, director of the Construction Innovation Hub, lead a discussion around the future of the construction industry, especially in respect of procurement; and 
4. Leadership coach Will Karlsen deliver some targeted communication and influencing skills training.

The inclusive and interactive sessions engaged all participants in lively and open discussions. Topped and tailed with opportunities to chat and get to know each other over breakfast and lunch, Insiders was as inclusive, informative and informal as planned.
