The claimant was awarded approximately £90,000 on 19 May 2005. The defendant did not pay the claimant. On 16 January 2006 His Honour Judge Coulson QC enforced the Adjudicator’s decision. The defendant failed to pay the judgment sum.
In February the claimant made an application for an interim charging order, which the court approved. The claimant in this application was requested that the interim charging order be made final. The defendant did not attend and was not represented, however their solicitor raised in correspondence some technical issues, which His Honour considered.
His Honour Judge Coulson QC made is quite clear that the defendant should have honoured the court judgment, and that the order should now be made final.
